Ukrainians in Poland may keep tax residency in Ukraine, not pay taxes in country of residence - BRDO

MOSCOW. July 18 (Interfax) - Ukrainians currently residing in Poland may maintain tax residency in Ukraine and not pay taxes in the country of residence, the Better Regulation Delivery Office (BRDO) said, citing the Polish Finance Ministry's official letter in response to an enquiry from BRDO and the IT Association of Ukraine.

"In May, BRDO and the IT Association of Ukraine appealed to the government of Ukraine and the Ministries of Finance of Bulgaria, Germany, the Czech Republic, Hungary, Poland, Romania, and Slovakia with a request not to change the tax residence of refugee entrepreneurs who ended up in these countries. The success of our advocacy is evidenced by the explanation we received from the central executive body of Poland the other day," the Ukrainian media quoted BRDO as saying in a press release on Monday.

According to the Polish Finance Ministry's letter, Ukrainians may maintain tax residency in Ukraine and not pay taxes in the country of residence, but, of course, income from working contracts with Polish counterparts is excluded.

As reported, the European Business Association called on the government to resolve the issue of tax residency of Ukrainian citizens abroad, since staying abroad for more than 183 days, they can be recognized as residents of the host country and there will be a risk of double taxation as regards their income received in Ukraine.
