Court returns without review of complaint to Gazprom on fine of antimonopoly regulator for $3.4 bln

KYIV. April 14 (Interfax) - The Economic Court of Kyiv with an order from April 13 returned without reviewing the particulars of claim of PJSC Gazprom on the complaint about the decision of the Ukrainian Antimonopoly Committee to set a fine in the amount of 85.966 billion hryvnia [$3.4 billion at the current exchange rate].

"The reason for the return was the unreliable formation of the particulars of the claim, and namely the failure to provide proof of authority of the person that signed the claim," the court said.

The Antimonopoly Committee levied the fine on January 22, 2016, after determining that Gazprom had abused its monopoly position in transiting gas through Ukraine. Gazprom argues that the Antimonopoly Committee does not have the authority to regulate transit through Ukraine.

Gazprom filed the lawsuit seeking to invalidate the fine on April 12. It proposes bringing in Naftogaz Ukrainy and Uktransgaz as third parties in the case.

The Antimonopoly Committee notified the parties of its decision on February 12, which can be appealed over the course of two months. In other words, Gazprom filed its appeal on the last possible day.

The official exchange rate on April 14 was 25.48 hrivni/$1.
