Russian Industry and Trade Ministry expects to define terms of take-or-pay contracts in electronics by end of year

SIRIUS. Sept 22 (Interfax) - The specific features of applying forward contracts on take-or-pay terms in the radio-electronic and microelectronic industries will be prepared by the end of the year, with corresponding amendments to legislation potentially submitted for government consideration in late 2025 or early 2026, Industry and Trade Minister Anton Alikhanov told journalists.

"Legal guarantees are needed, similar to those we have in the energy sector where there are take-or-pay contracts, meaning termination at the consumer's wish is impossible," Alikhanov said when answering a question about under what conditions the forward contract mechanism could start working in various industrial sectors, including electronics.

Implementing the take-or-pay mechanism in electronics will require amendments to legislation, which are currently being coordinated by the Industry and Trade Ministry and the Digital Development Ministry, he said.

"Ideally, we will aim to describe all the basic terms together with colleagues from the Digital Development Ministry, considering the formalized contracts in this industry, by the end of the year, and submit proposals to the government leadership either at the end of this year or the beginning of next year," he said.

After being tested in radio electronics and microelectronics, the take-or-pay norms will be applied in other industrial sectors. "Of course, while testing this in the radio-electronic market, we will have designing a broad overall norm in mind," he said.
