Court prohibits Naftogaz of Ukraine from enforcing any decisions under 2019 transit agreement as interim measure

MOSCOW. June 10 (Interfax) - The Arbitration Court of St. Petersburg and the Leningrad Region has granted Gazprom's claim for interim measures in a lawsuit filed on June 5, in which the concern requires a ban on receiving and enforcing in any state other than Russia any arbitration awards or any court decisions against Gazprom in a dispute arising from or in connection with the agreement of December 30, 2019, on the provision of services for organizing the transportation of natural gas through the territory of Ukraine, including decisions and other judicial acts obtained within the framework of or in connection with a case in the International Arbitration Court of the International Chamber of Commerce (ICC) regarding the property of Gazprom or its affiliates, the court's decision says.

The interim measures taken by the court on June 9 are expressed in the prohibition of these actions until the entry into force of the judicial act based on the results of the consideration of this case.

Naftogaz of Ukraine is also prohibited from initiating, continuing or supporting against Gazprom any arbitration (arbitration) or judicial proceedings and procedures outside Russia on anti-claim injunctions in a dispute from or in connection with the transit agreement until the entry into force of the judicial act based on the results of the consideration of this case.

The decision recalls that Naftogaz of Ukraine applied to the International Arbitration Court of the International Chamber of Commerce with a demand to recover from Gazprom $150 million in debt, as well as penalties and legal costs under the agreement on the provision of gas transportation services through the territory of Ukraine.
